This Privacy Statement is provided by Akkio Inc. (“Akkio,” “we,” “our,” or “us”), the controller of the personal information described herein, located at 7 Whittier Pl, Ste 108, Boston, MA 02114. You may contact us at legal@akkio.com.

Akkio values the privacy of the individuals who use our website and related services that link to this Privacy Statement (collectively, the “Service”). This Privacy Statement explains how we collect, use, and share information from users of our Service (“you”). By using our Service, you agree to the collection, use, disclosure, and procedures this Privacy Statement describes. In addition to this Privacy Statement, your use of our Service is subject to our Website Terms of Service (akkio.com/terms). Note that enterprise clients may have different terms pursuant to any platform license agreement between the parties.

Key Privacy Disclosures

We Do Not Sell Your Personal Information

We do not sell your personal information to third parties in exchange for monetary payment, regardless of age. We do share personal information with LinkedIn for cross-context behavioral advertising purposes, as described below.

Targeted Advertising and Your Right to Opt Out

We engage in minimal targeted advertising. Specifically, we use HubSpot to sync contact lists and company lists to LinkedIn for the purpose of displaying targeted advertisements to individuals on LinkedIn’s platform. To do this, HubSpot hashes and transmits certain contact identifiers — such as name and email address — to LinkedIn for contact list audiences, and company name and website domain for company list audiences. LinkedIn matches these against its member database to build targetable audiences. This activity may constitute “sharing” of personal information for cross-context behavioral advertising under applicable state privacy laws, including the CCPA.

You have the right to opt out of this sharing. To opt out, you may: (1) complete our online opt-out form at https://forms.gle/zrhEVbpewV8i313PA; or (2) email us at legal@akkio.com with the subject line “Opt Out of Targeted Advertising.” Please include your name and the email address you believe we may have on file. We will process your request and remove you from applicable LinkedIn audience syncs within a reasonable time. Please note that opting out will not remove any ads you may see on LinkedIn that are targeted based on LinkedIn’s own data about you — it will only prevent us from using your information to build our targeted audiences.

Sensitive Personal Information

We do not use or disclose sensitive personal information for purposes other than those permitted under applicable law (including the limited purposes specified in CCPA regulations §7027(m)). We do not offer a Notice of Right to Limit Use of Sensitive Personal Information because we do not use sensitive personal information beyond those permitted purposes.

Third-Party Tracking Across Other Websites

We use third-party analytics services, including Google Analytics, that may collect information about your online activities over time and across different websites or online services when you use our Service. This includes the use of cookies and similar tracking technologies. Google Analytics may associate your activity on our Service with your activity on other websites it tracks. You may opt out of Google Analytics by using the Google Analytics opt-out browser add-on available at https://tools.google.com/dlpage/gaoptout, or by managing your cookie preferences through our Cookie Settings.

Automated Decision-Making Technology (ADMT)

Akkio is an AI platform. Our Service enables customers to build and deploy AI models for purposes such as forecasting, classification, and data analysis. When Akkio’s AI models are used to make or assist in making decisions about individuals that produce legal or similarly significant effects, this may constitute automated decision-making technology (“ADMT”).

If you are subject to a decision made using ADMT through our Service, you may have the right to: (1) access information about how the ADMT functions and the types of decisions it produces; and (2) opt out of having ADMT applied to decisions concerning you. To exercise these rights, please contact us at legal@akkio.com. Note that in most cases Akkio acts as a processor on behalf of our business customers, who are the controllers of decisions made using our platform. If you are subject to a decision made by an Akkio customer using our AI tools, you should direct your request to that business customer first.

Information We Collect

We may collect a variety of information from or about you or your devices from various sources, as described below.

Information You Provide to Us

Registration. When you register for an account, we may ask for information such as your name, company, email, username, and password.

Payment and Billing Information. Financial information in connection with billing, including billing details and address.

Your Data. When you use the portion of our Service that enables users to create AI models, we collect any data sets or content you submit so we can provide you with AI models.

Communications. If you contact us directly, we may receive additional information about you, such as your name, email address, message contents, and any attachments. We also collect information when you sign up for newsletters or updates.

Information We Collect When You Use Our Service

Cookies and Similar Technologies. We collect information using cookies, pixel tags, or similar technologies. We may use both session cookies (which expire when you close your browser) and persistent cookies. Please review your browser’s “Help” settings to manage your cookie preferences. Note that disabling cookies may limit certain Service features.

Device Information. We receive information about the device and software you use to access our Service, including your IP address, web browser type, operating system version, phone carrier and manufacturer, device identifiers, and mobile advertising identifiers.

Usage Information. To help us understand how you use our Service and improve it, we automatically receive information about your interactions, such as the pages or content you view, searches you conduct, and the dates and times of your visits.

How We Collect and Use Personal Information

The following table describes the categories of personal information we collect, the specific business purposes for which we collect and process them, and the business purposes for which we may disclose them to third parties.

Identifiers (name, email, IP address, username, device IDs): Collected to create and manage your account, provide the Service, communicate with you, send marketing communications, ensure security, and comply with legal obligations. Disclosed to service providers who assist with account management, email delivery, analytics, and security. Hashed email address and name disclosed to LinkedIn (via HubSpot) for targeted advertising purposes.

Commercial Information (billing details, purchase records): Collected to process payments, provide the Service, and comply with financial and tax obligations. Disclosed to payment processors and financial service providers.

Internet/Network Activity (browsing history, interactions with Service): Collected to improve and personalize the Service, understand usage patterns, and for analytics. Disclosed to analytics providers such as Google Analytics.

Geolocation Data (general location inferred from IP address): Collected to provide localized features and for analytics. Disclosed to analytics providers.

User-Submitted Data (data sets and content submitted for AI model creation): Collected to provide the core AI modeling features of the Service. Disclosed to cloud infrastructure providers (AWS, GCP) as necessary to operate the Service.

Inferences (profiles derived from the above): Created to understand preferences and improve the Service. Not disclosed to third parties for their independent use.

We do not collect or use personal information for purposes materially different from those disclosed in this Privacy Statement without providing you advance notice and, where required, obtaining your consent.

How We Share Personal Information

We may share information we receive from or about you as described below. We do not sell your personal information to third parties in exchange for monetary payment, regardless of age. We do share personal information with LinkedIn for targeted advertising purposes as described below. The following describes the specific purposes for which we disclose personal information to third parties:

LinkedIn (via HubSpot) — Targeted Advertising. We use HubSpot to sync contact lists and company lists to LinkedIn for the purpose of displaying targeted advertisements on LinkedIn’s platform. For contact list audiences, HubSpot hashes and transmits contact identifiers (name, email address) to LinkedIn. For company list audiences, HubSpot transmits company name and website domain. LinkedIn matches this data against its member database to build targetable audiences. This sharing is for cross-context behavioral advertising purposes. Analytics Partners. We disclose internet activity and device information to Plausible and Google Analytics for the business purpose of analyzing how users interact with our Service so we can improve it. Google Analytics may also collect information about your use of other websites. You can opt out via https://tools.google.com/dlpage/gaoptout or your Cookie Settings.

Vendors and Service Providers. We disclose information to vendors and service providers retained to help us provide the Service, including HubSpot (CRM and marketing automation), hosting providers (AWS, GCP), payment processors, email service providers, and customer support tools. These providers are authorized to use your information only as necessary to provide services to us. Our use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

As Required by Law. We may disclose information to comply with law enforcement requests and legal process, such as a court order or subpoena, or to protect the rights, property, or safety of Akkio, our users, or others.

Merger, Sale, or Other Asset Transfers. We may transfer information in connection with a corporate transaction such as a merger, acquisition, or sale of assets. The use of your information following any such event will be governed by the provisions of this Privacy Statement in effect at the time the information was collected.

Consent. We may also disclose your information with your permission.

Data Retention

We retain personal information only for as long as necessary to fulfill the purposes described in this Privacy Statement, unless a longer retention period is required or permitted by law.

  • Account information: Retained for the duration of your account and for up to 3 years after account closure, unless a longer period is required by law.
  • Billing and transaction records: Retained for 7 years to comply with financial and tax obligations.
  • Usage and analytics data: Retained for up to 2 years.
  • Communications and support records: Retained for up to 3 years.
  • Legal and compliance records: Retained as required by applicable law, which may be up to 7 years or longer.
  • AI model data submitted by users: Retained for the duration of the active account. Upon account closure, data is permanently deleted within 2 days of voluntary closure and within 32 days of involuntary suspension.

When personal information is no longer needed, we securely delete or anonymize it in accordance with our data retention policies.

Third-Party Services

The Service allows you to, upon your direction, export information to third-party services. We are not responsible for the practices of these third parties. This Privacy Statement does not apply to your activities on those third-party services or any information you disclose to them. We encourage you to read their privacy policies before providing any information.

Security

We implement reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, use, disclosure, alteration, and destruction. However, as no electronic transmission or storage of information can be entirely secure, we cannot guarantee absolute security.

Children

We do not knowingly collect, maintain, or use personal information from children under 13 years of age, and no part of our Service is directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Statement, please alert us at legal@akkio.com.

Your Privacy Rights

Rights Available to All Users

Depending on where you reside, you may have the following rights regarding your personal information:

  • Right to Know/Access: Request disclosure of the categories and specific pieces of personal information we have collected about you, the purposes for collection, and the categories of third parties with whom we share it.
  • Right to Correct: Request correction of inaccurate personal information.
  • Right to Delete: Request deletion of your personal information, subject to certain exceptions.
  • Right to Data Portability: Request a copy of your personal information in a portable, machine-readable format.

Verification Process

To protect your privacy and security, we will verify your identity before fulfilling any consumer rights request. The verification process may vary depending on the nature of the request:

  • For requests to access or receive a copy of personal information, we will verify your identity by matching information you provide with information we maintain on file (such as email address and account details).
  • For requests to delete personal information, we may require additional verification steps, such as confirming your identity through your registered email or account.
  • We will not require you to create a new account to exercise your rights, but we may ask you to use your existing account for verification. We will respond to verifiable requests within the timeframes specified under applicable law (generally 45 days, with a possible 45-day extension).

Authorized Agents

You may designate an authorized agent to submit a consumer rights request on your behalf. To use an authorized agent, you must: (1) provide the agent with signed written permission to submit the request; and (2) verify your own identity directly with us, or provide your authorized agent with a power of attorney. To opt out of our sharing of your personal information with LinkedIn for targeted advertising purposes, you may use either of the following methods:

We will process your request and remove you from applicable LinkedIn audience syncs. We will confirm completion within the timeframes required by applicable law (generally 45 days).

Please note: opting out through us will prevent Akkio from including you in our LinkedIn targeted audience lists. It will not affect ads LinkedIn shows you based on LinkedIn’s own data or your LinkedIn profile settings. To manage your broader LinkedIn ad preferences, visit your LinkedIn account settings at linkedin.com/psettings/advertising.

Appeal Process

If we decline to take action on your privacy rights request, we will notify you of our decision and the reasons for it within the applicable response period. You may appeal our decision by emailing legal@akkio.com with the subject line “Privacy Request Appeal” and a description of your original request and the basis for your appeal. We will respond to your appeal within the timeframe required by applicable law. If your appeal is denied, you may have the right to contact your state’s Attorney General as described in the applicable state addendum below.

Consumers Under 18 Years of Age

We do not sell or share the personal information of consumers we know to be under 18 years of age. If you are under 18 and have provided personal information to us, you may request deletion of that information by contacting us at legal@akkio.com. We will process such requests in accordance with applicable law.

International Transfers of Data

Our Service is hosted in the United States. If you use our Service from the European Union or other regions with laws governing data collection and use that differ from U.S. law, please note that you are transferring your personal information to the United States for storage and processing. We may also transfer your data from the U.S. to other countries in connection with operating the Service. By providing information on or to the Service, you consent to such transfer, storage, and processing.

European Economic Area and United Kingdom Disclosure

If you are located in the European Economic Area or the United Kingdom, please review this additional information. Akkio is the controller of the personal information you submit to create and administer your account (typically, name and email address).

Legal Basis for Processing

When we process your personal information, we will only do so when we have a valid legal basis, including:

  • Consent. We have your consent to do so, for example when we ask for your consent to use non-essential cookies.
  • Contractual Necessity. We need to use your personal information to perform our responsibilities under our contract with you, such as processing payments and providing the Service.
  • Legitimate Interests. We or a third party have a legitimate interest in processing your personal information, such as to communicate with you about the Service, and to provide, secure, and improve the Service.

Note that there are exceptions and limitations to each of these rights. We will post any adjustments to this Privacy Statement on this page, and the revised version will be effective when it is posted. Notice of Right to Opt-Out of Sharing

Because we share personal information for cross-context behavioral advertising, California residents have the right to opt out of this sharing. Sensitive Personal Information

We do not offer a Notice of Right to Limit Use of Sensitive Personal Information because we do not process sensitive personal information beyond those permitted purposes.

Your California Privacy Rights

California residents have the following rights under the CCPA/CPRA:

  • Right to Non-Discrimination. We will not discriminate against you for exercising any of your CCPA/CPRA rights.

Verification Process

We will verify your identity before processing your request. For requests submitted by email, we will verify by matching information you provide against our records (e.g., email address, account details). For requests to delete, we may apply a higher standard of verification. Requests from authorized agents require signed written permission from you and independent verification of your identity.

Shine the Light

California Civil Code Section 1798.83 permits California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please contact us at legal@akkio.com.

Colorado Privacy Act (CPA)

This Addendum applies to residents of Colorado and supplements our Privacy Statement above. It is provided pursuant to the Colorado Privacy Act (“CPA”), effective July 1, 2023.

ADDENDUM C: OREGON RESIDENTS

Oregon Consumer Privacy Act (OCPA)

This Addendum applies to residents of Oregon and supplements our Privacy Statement above. It is provided pursuant to the Oregon Consumer Privacy Act (“OCPA”), effective July 1, 2024.

ADDENDUM D: RHODE ISLAND RESIDENTS

Rhode Island Data Transparency and Privacy Protection Act (RIDTPPA)

This Addendum applies to residents of Rhode Island and supplements our Privacy Statement above. It is provided pursuant to the Rhode Island Data Transparency and Privacy Protection Act (“RIDTPPA”), effective January 1, 2026.

Information Sharing Disclosure

As required by the RIDTPPA, we disclose the following:

  • Categories of personal data collected: identifiers, commercial information, internet and network activity, geolocation data, user-submitted data, and inferences.

We will obtain your affirmative opt-in consent before collecting or processing sensitive personal data as defined under the RIDTPPA, including data revealing racial or ethnic origin, religious beliefs, mental or physical health conditions, sexual orientation or gender identity, citizenship or immigration status, genetic or biometric identifiers, personal data from individuals known to be under 18, and precise geolocation data.

Consent Revocation

Where we process your personal data based on consent, you may revoke that consent at any time. We will cease processing for the relevant purpose within 15 days of receiving your revocation.

How to Exercise Your Rights and Appeal

To submit a rights request or opt out of targeted advertising, complete our online opt-out form at https://forms.gle/zrhEVbpewV8i313PA or email legal@akkio.com. We will respond within 45 days (with a possible 45-day extension). If we decline your request, we will explain why and provide appeal instructions. Virginia Consumer Data Protection Act (VCDPA)

This Addendum applies to residents of Virginia and supplements our Privacy Statement above. It is provided pursuant to the Virginia Consumer Data Protection Act (“VCDPA”), effective January 1, 2023.
